Welcome to Munch ("Munch", "usemunch.com", "the App"). These Terms and Conditions ("Terms") govern your access to and use of the Munch app and website (usemunch.com).

1. Use of the Service

The app is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the app or website.

You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

If you use the app to create surveys, you are responsible for ensuring that your surveys and data collection comply with all applicable laws and regulations, including those related to privacy and data protection.

You acknowledge that survey responses may be analyzed using third-party providers and consent to such processing.

You are responsible for ensuring the legality of projects, tasks, and files uploaded to the app.

2. Description of Services

Munch offers the following features. This list a non-exhaustive list of all the features:

  • Survey Creation and Sharing: Users can create and share surveys with end users.
  • Response Collection: Users receive responses from end users.
  • Response Analysis: Responses are analyzed using third-party providers.
  • Project Management: Users can create projects, upload files, and add tasks.
  • Premium Features: Users can purchase credits to access premium features.

3. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any changes by updating the "Last Updated" date of these Terms. Your continued use of the App after any modifications indicates your acceptance of the changed Terms.

4. Intellectual Property

All content on the app and website, including text, graphics, logos, and software, is owned by Munch or licensed to Munch and is protected under applicable intellectual property laws.

You own the data that you create (e.g., surveys, projects) and grant a license to use this data for service provision.

You may not reproduce, distribute, or modify any content without prior written permission.

5. Prohibited Uses

You agree not to:

  • Use the app or website for unlawful purposes.
  • Attempt to hack, disrupt, or otherwise interfere with the app or website.
  • Collect or harvest personal information of other users.
  • Use the app to create or distribute surveys containing unlawful, defamatory, or harmful content.
  • Misuse survey responses or the analysis generated through the app.

6. Limitation of Liability

To the fullest extent permitted by law, Munch shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the app or website, including any loss or damage related to survey data or responses.

You agree to defend and hold Munch harmless against claims arising from their use of the app.

7. Age Restrictions

Minimum Age: The app is not intended for users under the age of 13.

Minors: Steps will be taken if minors use the app.

8. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict of laws principles. Any disputes will be resolved in courts located in Ontario.

9. Termination

Munch reserves the right to suspend or terminate your access to the app or website for any violation of these Terms.
